By accessing or using ForkliftTracker™ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, customers, and others who access or use the Service.
Service Description
ForkliftTracker provides a cloud-based equipment inspection management platform that enables organizations to:
- • Conduct digital equipment inspections
- • Maintain compliance with OSHA and safety regulations
- • Track equipment maintenance and performance
- • Generate inspection reports and analytics
- • Manage user roles and permissions
User Accounts and Responsibilities
Account Creation
- • You must provide accurate and complete information when creating an account
- • You are responsible for maintaining the security of your account credentials
- • You must notify us immediately of any unauthorized access to your account
- • One person or entity may maintain only one account
Acceptable Use
- • Use the Service only for lawful purposes and in accordance with these Terms
- • Ensure all data entered is accurate and current
- • Respect the intellectual property rights of ForkliftTracker and others
- • Do not attempt to gain unauthorized access to any part of the Service
- • Do not interfere with or disrupt the Service or servers
Data Ownership and Privacy

Service Availability and Support
We strive to maintain high availability of the Service, but cannot guarantee uninterrupted access. We may perform maintenance, updates, or experience outages that temporarily limit access.

Payment Terms
Subscription Fees
- • Subscription fees are charged in advance on a recurring basis
- • Fees are non-refundable except as required by law
- • We may change pricing with 30 days' advance notice
- • Failed payments may result in service suspension
Free Trial
Free trials are limited to one per organization and may have feature or usage limitations.
Limitations and Disclaimers
Important: ForkliftTracker is a tool to assist with equipment management and compliance. It does not replace professional judgment, equipment inspections by qualified personnel, or compliance with applicable safety regulations. Users remain responsible for ensuring proper equipment maintenance and safety compliance.
Limitation of Liability
To the maximum extent permitted by law, ForkliftTracker shall not be liable for:
- • Indirect, incidental, special, or consequential damages
- • Loss of profits, revenue, or business opportunities
- • Equipment failures or safety incidents
- • Data loss or corruption (beyond our backup and recovery efforts)
Termination
By You
You may terminate your account at any time by contacting support or using account settings. Termination does not entitle you to a refund of prepaid fees.
By Us
We may terminate or suspend your account for violations of these Terms, non-payment, or other reasonable business reasons with appropriate notice.
Data Export
Upon termination, you may export your data for a period of 30 days, after which it may be permanently deleted.

Changes to Terms
